Terms of Service

Welcome to Mornist. These Terms of Service ("Terms") govern your use of the Mornist mobile application and related services (the "Service") operated by OguzHub ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Mornist, you confirm that you are at least 13 years old and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Mornist is an AI-powered behavioral transformation app designed to help users build consistent early-rising habits. The Service includes:

• Automated alarm scheduling using Neuro-Periodization algorithms
• AI-generated personalized morning speeches and evening passages
• Voice synthesis of content using text-to-speech technology
• Progress tracking, analytics, and engagement metrics
• Adaptive mode transitions based on user performance

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to update it as needed. You are responsible for all activity under your account. Notify us immediately at contact@mornist.app if you suspect unauthorized access.

4. Alarm Disclaimer

Mornist is not a medical device, safety system, or critical infrastructure. While we strive to deliver alarms reliably, we cannot guarantee that alarms will fire in all circumstances. Factors outside our control include but are not limited to:

• Device power state, battery optimization settings, or Do Not Disturb modes
• Operating system restrictions on background processes
• Network connectivity issues affecting content delivery
• Device hardware or software malfunctions

You should not rely solely on Mornist for time-critical wake-ups where failure could result in harm, financial loss, or missed obligations. We are not liable for any damages resulting from a missed or failed alarm.

5. AI-Generated Content

Mornist uses artificial intelligence (Amazon Bedrock / Claude) to generate personalized speeches and content. This content is:

• Generated algorithmically and may not always be perfectly relevant or accurate
• Not a substitute for professional medical, psychological, or therapeutic advice
• Provided on an "as-is" basis without warranties of any kind

We curate and filter AI-generated content to align with our positive, non-shaming brand philosophy, but we cannot guarantee the appropriateness of every generated message.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the application
• Interfere with or disrupt the Service or its servers
• Create multiple accounts to circumvent limitations
• Share your account credentials with others
• Use automated scripts or bots to interact with the Service

7. Intellectual Property

The Service, including its design, algorithms, curated content, branding, and code, is the intellectual property of OguzHub and is protected by applicable copyright and intellectual property laws. AI-generated content created for your personal use within the app is licensed to you for personal, non-commercial use only.

8. Subscription & Payments

Mornist may offer premium features through paid subscriptions. Payment terms, pricing, and billing cycles will be clearly communicated before purchase. Subscriptions are managed through the respective app store (Apple App Store or Google Play Store), and their refund policies apply.

9. Limitation of Liability

To the maximum extent permitted by law, OguzHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. You may delete your account at any time via mornist.app/delete-account. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, stop using the Service and delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
